Liability Waiver
I acknowledge I am aware that Twisted A Farm (7600 Roma Place, Salinas, Ca. 93907) is a working farm with livestock, uneven ground, poison oak, farm machinery and other traits of a farm.

Twisted A Farm tours & workdays take place in and around an operating farm. The tours may include visiting with goats, chickens, ducks, pigs, rabbits, horse, cattle, bees and any other farm animals and/or household pets. You may visit production areas used for milking, feeding, grooming, harvesting, gardening, etc. The pens, corrals, barns, outbuildings, gardens, and surrounding grounds will have various equipment, bumpy and uneven walkways, electric fences, and facilities to support these operations, including the presence of livestock and farm and other features that pose HAZARDS AND DANGERS TO PERSONS VISITING THE FARM WHICH CAN RESULT IN INJURY OR DEATH.

I have been advised to stay on walkways and pathways to the maximum extent possible. I understand that visiting the farm may have inherent risks of injury to me personally and to my belongings/equipment. I understand that I am responsible for the acts of, as well as any injuries to, myself and any children or animals I may bring onto the property, and that they are not permitted to wander the grounds (a) unsupervised for children, and (b) unleashed for animals. I understand that all animals visiting the farm must be approved ahead of time and will be permitted at the property owner’s discretion.

In consideration of participating in the tour and/or workdays, the visitor, with full knowledge of these and other unknown hazards and dangers, assumes all risk of injury to persons and property in or about the premises of Twisted A Farm and will hold and defend Twisted A Farm, The Alaga Family, David Alaga, Rebecca Alaga, Haleigh Alaga, and their agents and employees free and harmless from any and all liability therefore, including costs and attorney’s fees.

The tour and/or workday participant, or visitor, for himself/herself, waives and releases any claims, demands, suits, and causes of action against Twisted A Farm, The Alaga Family, David Alaga, Rebecca Alaga, Haleigh Alaga and their agents and employees, while present upon the premises of Twisted A Farm and arising from any cause whatsoever, including any acts or omissions of the releasees.

The tour and/or workday participant, or visitor, agrees that any and all medical expenses for injuries occurring upon the premises of Twisted A Farm, shall be submitted to their own health insurance plans and NOT to releasees and/or releasees’ insurance carriers.

The tour and/or workday participant, or visitor, acknowledges that the provisions of this paragraph are contractual and not mere recitals; having been carefully reviewed, considered, accepted, and agreed by the tour and/or workday participant or visitor.

I hereby acknowledge that this release will extend to any accidents, damages, or claims arising out of my participation in any activity or caused by my own acts (or negligence) or the acts of anyone or any animal occurring while at or related to activities at Twisted A Farm.

I further agree that I will defend, indemnify, and hold Twisted A Farm harmless against all claims, demands, and causes of action including court costs and attorneys’ fees, directly or indirectly arising from any action or other proceeding brought or prosecuted for my benefit contrary to this release and extended to all claims of every kind and nature whatsoever, whether known or unknown. I expressly waive any benefits I may have under Section 1542 of the California Civil Code relating to the release of unknown claims.

Furthermore, I agree to be photographer and/or video taped (or for my child/animals to be photographed and/or video taped) while on the premises of Twisted A Farm. I understand that any photographs and/or video may be used for the purpose of promoting the farm via Facebook, Instagram, Kickstarter, the Farm website, 4-H social media, etc.

By signing up for a Twisted A Farm public or private tour, visit, or workday I acknowledge that I have fully read, understand, and agreed to the statements above.
